The second annual Campaigns & Elections’ Politics magazine Reed Awards were presented this evening in Washington, DC to political and public affairs professionals at the top of their game. “Becoming a Reed Award finalist is tough. Actually winning a Reed Award is only accomplished by the most impressive creative political and public affairs talent in the world,” said Jordan Lieberman, publisher.

October Update
With November right around the corner, it’s hard to believe a year has passed since the 2008 elections. Here’s a reality check – one year ago this week, then-candidate Obama upped the advertising ante with a video game ad buy, the Phillies were on their way to winning their first world series in 28 years, and the world had just met Joe the Plumber.
But while this all might feel like just yesterday, the cycle has kicked off once again with off-year elections just days away in NJ, NY, and VA. Wishing our friends in those battlegrounds all the best in the coming days.

Thanks to everyone who made it out to Karaoke in the Capital Wednesday night – the singing was great (really!), the crowd had a blast, and our fearless President Dean provided some excellent backup support for a winning rendition of “Material Girl.” Proceeds from the event go to The Mr. Holland’s Opus Foundation, which provides musical instruments to children who couldn’t otherwise afford them. According to MPAA advertising guidelines, if a movie producer or distributor creates an adult site to advertise an R- or NC-17-rated movie, the site “must be accessible only through a suitable age-verification system that blocks access by children.” MPAA Advertising Handbook at 35 (2006) (on file with Commission staff). Universal Pictures informed the Commission that it acquired age verification technology from a third party, enabling it to restrict certain designated content on the website for Miami Vice to adult users (18 and over) for clips and other materials. To access certain content, users were advised that they must be over 18 years old to proceed, and instructed to input their names, birth dates, and zip codes. The web page stated that the information would be checked against government records. The information then was sent directly to Verification Integrity Financial Assurance Corporation (“Verifac”), a company that specializes in providing age verification services; this information reportedly was not stored after the verification process. After a successful verification process, the visitor was allowed into the restricted site, which at the time included movie clips containing violence and profanity.

(Washington, DC) – Campaigns and Elections’ Politics magazine has announced that one current and one former Aristotle (www.aristotle.com) colleague have been named 2009 Rising Stars in Politics. Brian Williams, Vice President of Product Strategy and Design at Aristotle, and Aristotle alumna Jessica Grounds, Senior Vice President of Stone’s Phones, were named by the independent judges. The Rising Star award acknowledges outstanding political professionals under the age of 35.
“We’re very proud of the recognition given to our Aristotle colleagues,” Aristotle founder and CEO John Aristotle Phillips said. “Brian is a brilliant technologist, and Jessica’s strategic expertise has brought her recognition inside and outside the US. They are both very deserving of this important award.”
A former staff member and adviser to several top political campaigns, Williams most recently served as an aide to the speaker of the US House of Representatives. He attended the United States Military Academy at West Point and has a bachelor’s degree in Information Technology and Political Science from the University of Central Florida.
Grounds, who worked at Aristotle at the start of her career, has since developed winning communications and message strategies for hundreds of democratic political campaigns. She is president of the Women Under Forty Political Action Committee.

FEC Version 6.4 Released May 14th |

The FEC disabled Version 6.3 and today released Version 6.4 of the electronic filing specifications. This release includes the Form 3L, which is used to report bundled contributions from lobbyists. 360, Campaign Manager, PAC Manager, and BackOffice were updated to comply with these new specifications in conjunction with the release and are available now. Clients using 360 and BackOffice simply need to login and use the applications as before. Clients using PAC Manager and Campaign Manager are encouraged to run LiveUpdate to obtain the latest version of the application.

Form 3L is a new form required by the FEC to disclose bundled contributions from lobbyist/registrants and lobbyist/registrant PACs. A Committee must file the Form 3L if it received two or more bundled contributions forwarded by, or credited to, a lobbyist lobbyist/registrant or a lobbyist/registrant PAC and the contributions aggregate in excess of $16,000 in a covered period (see filing schedule below for a description of these periods). The rules went into effect on 3/19/09, and that is the first possible date on which information/transactions need to be captured.
Release Timeline
The FEC has laid out the following timeline for the release of electronic filing for the Form 3L. The initial coding is nearly done in all three platforms and we are awaiting the release of the vendor tools and the test site in order to work out any remaining bugs.
- 5/4 Vendor tools (VenPak) released
- 5/6 Vendor test site enabled for V6.4 filings
- *5/14 V6.4 live/production site enabled for 6.4 filings & V6.3 filings are cut off (note that there will be no period in which both formats are accepted simultaneously)

In calendar years where there is no regularly scheduled November general election committees must file quarterly reports on April 15, July 15, October 15, and January 31 of the following year. Quarterly reports filed on July 15 and January 31 must also include total reportable bundled contributions for the semi-annual covered periods of January 1 through June 30, and July 1 through December 31, respectively. Reports for the 12-Day Pre-Election covered period include activity from the day after the closing date of the last report filed through the 20th day before the election and are filed no later than the 12th day before any primary or general election in which the candidate seeks election. Reports for the 30-Day Post-General Election covered period include activity from the day after the closing date of the last report filed through the 20th day after the election and are filed no later than 30 days after the general election.
Political Party Committees and Leadership PACs and Authorized Committees of Presidential Candidates
A party committee or Leadership PAC with bundled contributions in excess of the reporting threshold during a covered period files FEC Form 3L at the same time as its FEC Form 3X. However, reporting committees that file Form 3X on a monthly basis may choose to follow a quarterly schedule for filing Form
3L. The Quarterly filing schedule is described above. Reports for the monthly covered periods must be filed no later than 20 days after the last day of the month.
Reporting Obligations
As stated above the Form 3L must be filed if a committee receives two or more bundled contributions forwarded by, or credited to, a lobbyist lobbyist/registrant or a lobbyist/registrant PAC and the contributions aggregate in excess of $16,000 in a covered period. The report consists of the Form 3L, Schedule A, and Schedule B. The Form 3L itself is simply a summary page where a committee will disclose its name, address, FEC ID, the coverage dates of the report, and amount of bundled contributions. Schedule A is used to report the full name and amount of bundled contributions from lobbyists. The individual contributions that make up the reported bundled contributions are not reported here. Those contributions are reported on the Form 3, Form 3X, or Form 3P. Schedule B is used to report refunds of any portion of any reported bundled contributions. The refund to the Lobbyist/Registrant is reported here. The refund to the individual who contributed is reported on the Form 3, Form 3X, or Form 3P rescpectively.

A new Contribution Type has been added to accommodate the reporting of bundled contributions. In order to disclose receipts on Schedule A of the Form 3L use the contribution type “Bundled”. This CT will work for Entity Type Individual and PAC. Contributions that make up the bundled contribution will be entered as they were before and still appear on the Form 3 or Form 3X.
Refunds on Schedule B will pull to the Form 3L is the Disbursement Kind “Bundled Refund.”

Enter the bundler as you would an Individual or PAC. On the right-hand side of the screen click “Enable Fundraiser”. Click the checkbox labeled “Is Registered” and then click update bundler settings.
Next enter the receipt from the Individual giving the contribution and click save. Next click the Additional Details button and search for the Bundler in the Fundraiser ID section
360 will automatically aggregate the bundled contributions and report the amount from the lobbyist/registrant on Schedule A of the Form 3L and the individual contributions on Schedule A of the Form 3, 3X, or 3P.
Refunds are entered in the same manner and the program will automatically aggregate the refunds on Form 3L and disclose the refunds to each individual/PAC on Form 3, 3X, or 3P.

Bundled Contributions are handled through the Soft Allocation feature. Adding a Soft Allocation to a monetary or in-kind contribution is a similar process to adding a partner. Under Soft Allocations, enter the name of the individual or organization click Find and Add. The amount will default to the full amount of the contribution.

A refund is handled in the same screen, the soft allocation screen, but that contribution that is being refunded must be marked as a reversal. Use the Reporting Code “Refunded Contribution” - this totals the refunds and will show up on Line 20a (on FEC Form 3) and lists the refunds in Schedule E (for CA Form 460).
If you have a reversal, DO NOT CHECK THE REVERSAL BOX ON THE ORIGINAL TRANSACTIONS. Instead, add a new contribution for the same amount & check the reversal box on that transaction. This way you’ll have two transactions that cancel each other out.
You just need to add it as a reversed contribution:
1. Go to the Donor’s Record.
2. Select Contribution under Add a Transaction.
3. Click the Reversal box and fill in the amount of the refund and the date.
4. Save changes.

Here is a brief update about the release of the new FEC v6.4 change:
The new proposed format for Version 6.4 of the FEC electronic filing specification was released today. The main change with this release is the addition of the new Form 3L. To accommodate this change the Form 3L itself was added and a few minor changes were made to Schedule A and Schedule B. Other changes include the omission of Form 3Z-1, an update to the Header to reflect v6.4, personal funds on Form 2 have been taken off the form. The release schedule appears below. The finalized version of the specification will be released April 10, 2009. The go-live date is May 14, 2009.

Who loves compliance? I do!
Changes to the FEC Form 1 are right around the corner. If you’re not sure if your PAC is required to amend their Statement of Organization (FEC Form 1), ask yourself the following questions:
- Is our PAC required to disclose on their Semi-Annual LD 203 form that the PAC was established or controlled by a registered lobbyist or registrant?
- Is your committee a Separate Segregated Fund with a connected organization which is registered and required to file the LD 203?
- Did a federally registered lobbyist play a primary role in the establishment in your PAC?
- Does a federally registered lobbyist direct the governance or operations of the PAC?
If you answered yes to any of the above questions, you need to amend your Statement of Organization by March 29, 2009 to stay in compliance with the FEC. The amendments for the FEC Form 1 all stem from the Honest Leadership and Open Government Act of 2007 honest leadership section 204 requiring campaign committees, leadership PAC’s and PPC’s to disclose bundled contributions they received from individual registered lobbyists and entities that are registered to lobby under the Lobbying Disclosure Act.
